Question 1: When is a dismissal in a redundancy situation regarded as fair?

Answer: A fair procedure will include four elements:

• redundancy selection
• consultation
• offer of suitable alternative employment (if appropriate)
• appeal

A subtlety that may not be evident from the statute books is that you should have good communication with employees throughout the redundancy period.  It always comes up in tribunals; poor communication invariably will mean losing the case!
